1. Introduction
These Terms & Conditions (“Terms”) govern the use of services, website, communications, and all dealings with Seed Disability Services Pty Ltd (“Seed Disability Services”, “we”, “us”, “our”).By accessing our services, entering into a service agreement, or using our website, you agree to be bound by these Terms.
These Terms apply to:
- NDIS participants (Plan, Self & Agency Managed)
- Aged Care clients (HCP, CHSP, private care)
- Private-paying clients
- Carers, guardians, nominees and representatives
- Allied health, support, nursing and community support clients
- Website and digital platform users
2. Service Eligibility
To access services, you must:
- Be an NDIS participant, aged care client, or private-paying client
- Provide accurate personal and medical information
- Agree to all required consent, service or intake documents
- Comply with all lawful and reasonable directions during service delivery
Seed Disability Services reserves the right to decline service if:
- Safety risks cannot be reasonably managed
- There is violence, aggression, harassment, or abusive conduct
- Policies, funding, legal, or ethical conditions cannot be met
3. Service Agreements
A written Service Agreement must be in place before supports are delivered. This may be signed by:
- The participant/client
- A guardian, nominee or authorised representative
- A plan manager or legal representative

- Frequency and duration
- Costs & billing method
- Rights & responsibilities
- Cancellation terms
- Complaints process
4. Fees, Billing & Payments
4.1 NDIS Clients
Charges follow the NDIS Pricing Arrangements & Price Limits in force at the time of service delivery.
4.2 Home Care Package (HCP) Clients
Where services are funded by Trilogy Care, payment terms follow HCP regulations.
4.3 Private Clients
Private fees, quotes and invoices apply. Payment is due within 7 days unless otherwise agreed.
4.4 Late or Failed Payment
Seed Disability Services may:
- Pause services until payment is received
- Charge late fees or recovery costs
- Refer unpaid invoices to debt collection
5. Cancellations & No-Show Policy
For most supports, a minimum of 7 days’ notice is required to cancel or reschedule a service.
If the required notice is not given:
- Up to 100% of the scheduled service cost may be charged
- This applies under NDIS, Aged Care, and private services
- Repeated cancellations may result in service suspension
We reserve the right to cancel services due to illness, weather, staff shortages, unsafe environments, or emergencies.
6. Your Responsibilities
You agree to:
- Treat staff, contractors and other clients with respect
- Ensure the environment is safe for service delivery
- Provide accurate medical and personal information
- Notify us of illness, risk, infection or behavioural concerns
- Follow lawful and reasonable instructions from staff
- Not engage in unsafe, aggressive, threatening or unlawful behaviour
7. Our Responsibilities
Seed Disability Services agrees to:
- Provide services with care, skill, professionalism and respect
- Follow NDIS Practice Standards & Aged Care Quality Standards
- Maintain worker screening, police checks, training & compliance
- Protect your privacy and personal information
- Respond to feedback, incidents, complaints and risks
- Ensure staff are appropriately qualified and insured
8. Risk, Safety & Duty of Care
We are committed to providing safe, high-quality support, however:
- Clients must disclose risks (medical, behavioural, environmental)
- We may refuse unsafe work environments
- We do not provide emergency medical services
- We are not liable for harm caused by failure to follow advice
- Clients remain responsible for their own decisions and behaviour
9. Website & Digital Use
By using our website, you agree not to:
- Copy, reproduce, or commercially exploit content
- Upload viruses, spam, or harmful material
- Hack, damage, or interfere with digital systems
- Impersonate another person or organisation
We provide general information only. Nothing on the website constitutes medical, legal or financial advice.
10. Confidentiality & Privacy
All information is handled in accordance with our Privacy Policy, the Privacy Act 1988, and the Australian Privacy Principles. A full copy of our Privacy Policy is available on request or via our website.
11. Liability & Indemnity
To the fullest extent permitted by law:
- Seed Disability Services is not liable for loss, damage, injury, delay, or costs arising from service delivery, except where negligence is proven
- You agree to indemnify us against claims arising from misuse, non-disclosure, unsafe conduct, or breach of these Terms
- We are not liable for third-party provider errors, delays, or failure to act
12. Termination of Services
Services may be ended by either party with 14 days written notice, unless immediate termination is justified due to:
- Threats, violence, or abuse
- Fraud, unlawful activity or non-payment
- Serious safety or ethical breaches
All unpaid charges remain payable after termination.
13. Changes to These Terms
Seed Disability Services may update these Terms at any time. Updated versions will be published on our website or provided in writing.
